NASS leadership: Court orders clerk, others to use open ballot system

A Federal Capital territory High Court has granted an interim injunction restraining the clerk of the National Assembly and the Senate and others from enforcing the Senate standing orders 2015 (as amended) in the conduct of leadership election at the 9th Assembly.

The court ordered that the principal officers of the National Assembly do not rely or enforce the Senate Standing order pending the determination of this suit.

Vanguard reports that in its order, the court stated that the Senate standing Orders 2011 (as amended) which prescribed the use of open ballot rather than secret ballot mode in the election process at the National Assembly be used.

The court's order followed a motion on notice and the accompany affidavit of Senator Jibrin Barau in suit number FCT/HC/BW/CV/136/2019 with Motion NO M/266/2019.

“An interim order restraining the 1st & 2nd Respondents and each of them whether by themselves or otherwise not to use any other senate standing orders for the inauguration of the 9th Assembly whatsoever including but limited to the election of Presiding officers of the senate on Tuesday, 11th June 2019 and any other day except the senate standing Orders 2011 (as amended) by the senate on the 24th May, 2011," the order said.

Igbokwe who represents Ahiazu Mbaise/Ezinihitte constituency and is also the leader of the south east caucus of the All Progressives Congress (APC) in his application said going against the party's decision of choice for Gbajabiamila to become speaker would be tantamount to disrespect of party's choice.

Stating that he swore to an oath to defend the law and the constitution, Igbokwe said the ruling party had already made its choice for the speakership position clear.
