Order fresh polls without APC candidate - Shinkafi tells election tribunal

Alhaji Sani Shinkafi, the governorship candidate for the All Progressives Grand Alliance (APGA) in the 2019 election in Zamfara state have called for a fresh poll without the participation of the All Progressives Congress (APC).

Shinkafi asked the state’s Governorship and State House of Assembly Elections Petitions Tribunal sitting in Abuja to nullify the March 9 governorship elections conducted in the state and order for a fresh elections without the participation of the APC and its candidate Mukhta Shehu Idris.

In a petition filed before the tribunal on March 29, Shinkafi through his lawyer, Ifeanyi Mbaeri, said Section 177(c) of the 1999 Constitution as amended states that “A person shall be qualified for election to the office of Governor of a state if inter alia: he is a member of a political party and is sponsored by that political party to contest the said election.”

Daily Trust reports that Shinkafi also noted that a political party seeking to sponsor or nominate candidates for elections under this section shall hold primaries for aspirants to all elective positions.

Citing Section 140(2) of the Electoral Act 2010 as amended, the APGA candidate said: “Where an election tribunal or court nullifies an election on the ground that the person who obtained the highest votes at the election was not qualified to contest the contest the election or marred by substantial irregularities or noncompliance with the provisions of this act, the election tribunal or court shall not declare the person with the second highest number of votes or any other person as elected, but shall order a fresh election.”

Furthermore, he urged the Tribunal to order the Independent National Electoral Commission (INEC) to conduct fresh polls in the state without the participation of the APC candidate within 90 days.

Meanwhile, Legit.ng previously reported that the senator representing Zamfara central, Kabir Marafa, has said that the APC's national chairman, Adams Oshiomhole, should be under no obligation to lie about happening in the state chapter of the party.

Recall that Oshiomhole had said that the APC Conducted primaries in the state, a position which Marafa claims is false.

Marafa said that it is shocking that at this level of his political career, Oshiomhole would stoop low and lie in such a way.
