- The police had invited Fani-Kayode over alleged conspiracy and criminal publication

A chieftain of the Peoples Democratic Party and the former minister of aviation, Femi Fani-Kayode, has filed a suit at the Federal High Court in Abuja seeking to stop the Nigeria Police from arresting and detaining him unlawfully.

The former minister filed the suit after receiving an invitation letter from the police over alleged conspiracy and criminal publication.

In a motion on notice dated August 28, 2018, and marked FHC/ABJ/CS/917/2018, the former Minister has asked the court to declare that the said letter of invitation by the police is unlawful, unjustifiable, illegal and unconstitutional, Tribune reports.

Fani-Kayode, through his lawyer, Dr Kayode Ajulo, also asked the court to declare that in accordance with the 1999 constitution, he cannot be so invited by law enforcement agents for undisclosed reasons and without adequate notice.

He said: “I became apprehensive and concerned about the intentions of the Nigerian Police and what my fate could be, should I visit the 1st and 2nd respondents office without filing this application."

Regardless of the suit, his counsel, Ajulo said he has prevailed on his client to honour the invitation on Tuesday, September 4, 2018.

NAIJ.com earlier reported that Fani Kayode wrote to the police force headquarters in Abuja to ask for the date of his interview to be postponed to either September 4 or 5, as the August 28 date given to him was not feasible.

The former minister, who described the content of the invitation letter from the police as vague, said that the change of date was so he could attend the ongoing national conference of the Nigerian Bar Association (NBA), holding in Abuja.
