Kenyan surrogate who recently delivered a child gets arrested for giving baby away to Chinese man (photo)

- Josephine Muthoni was charged alongside a doctor, a Chinese and Singapore nationals for attempting to traffic a toddler

- According to Josephine, she had an agreement to be a surrogate mother

- She would then be receiving KSh 30,000 (N108,000) every month until she delivered

- Muthoni would receive KSh 50,000 (N180,000) after she had delivered and the child released through due court process

A 27-year-old woman who agreed to be a surrogate mother was on Monday, July 30, charged with colluding with a doctor and a Chinese man to traffic a 12-days-old baby to Singapore from a hospital in Mombasa.

Josephine Muthoni Kariuki who delivered baby Noe Yu Ji was charged alongside Neo Kian Fu and doctor Mahesh N Chudasama at a Mombasa court.

Muthoni, Kian Fu, and Dr Chudasama were charged for attempting to traffic the baby whom they allegedly claimed was their son. They were also charged with unlawfully adopting the child.

The three who appeared before senior principal magistrate Henry Nyakweba denied the two counts of attempted human trafficking with Kian Fu saying he was on a three-months tourist visa and his passport was valid.

The trio was released on a bond of KSh 1 million (N3,600,000) with one surety with an alternative cash bail of KSh 100, 000 (N360,000).

It is alleged on diverse dates between July 16, 2018, and July 28, at Mombasa Hospital Muthoni and Chudasam jointly offered to Kian Fu a child namely Yu Jie for guardianship to facilitate the child’s removal from Kenya to Singapore.

According to a police report, the woman had entered into a contract worth KSh 500,000 (N1,800,000) to be a surrogate mother to a Chinese couple.

She said she had an arrangement made before lawyer Muthee Soni that she would rent her womb to Neo Kian Fu who left the country after he gave his sperms and be paid KSh 30,000 (N108,000) per month.

She further explained after a deduction of KSh 1, 500, she would receive KSh 28, 500 each month for the entire gestation period with a final sum of KSh 500,000 after documentation of the child and release through court procedures.

Muthoni gave birth to Yu Jie at Mombasa Hospital on July 18, at 3pm and Chudasama handed the baby to Kian Fu without her knowledge.

It is said that Chudasama had initiated the process and produced a copy of the letter dated November 11, 2016, from medical practitioners and dentist board chairman George Magoha.

The letter authorised the doctor the expansion of the spectrum or ART Service in Mombasa. The said agreement was drafted by Muthee Soni advocates based in Mombasa and executed by both parties.

The legal formalities were handled by advocate Christine Kipsang who is an advocate at the Children’s Court.

Kipsang produced an order issued by Tononoka Children’s court granting parental rights to the intended parent, Kian Fu. The birth certificate indicated Muthoni as the mother to Yu Jie and Kian Fu the father.

The baby was taken to Baby Life Rescue Center pending application for protection and care at the Children's court in Mombasa. The case is scheduled for pre-trial on August 13, 2018.
