The police prosecutor, Inspector Adegoke Taiwo, informed the court that the five convicts conspired among themselves to commit a felony to wit stealing on July 5, 2016, at Erin Osun, in Osogbo, Osun state, Nigerian Tribune reports.

He explained that Odebiyi Yinka and Ayoola Samson stole 1,600 fowls valued at N3.2 million, belonging to Aluko Titilayo Farms in Erin Osun.

Taiwo added that the three nursing mothers received the fowls from the duo, knowing fully that they were stolen fowls.

According to the police prosecutor, the offence contravened Section 516 and Section 383, punishable under Section 390 (9) and Section 427 of the Criminal Code Cap 34, Volume 11, Laws of Osun state of Nigeria, 2003.

However, the defence counsel, Barrister B.Y. A Dada pleaded with the court to temper justice with mercy, pointing out that the convicts have been able to pay N200,000 to the complainant, just as she begged that the nursing mothers should be considered due to their present status.

Delivering her judgment, presiding Magistrate Awodele Modupe Adedoyin sentenced the convicts to six months imprisonment with an option of fine of N10,000 each.
