Abuja court nullifies victory of APC senator- elect

- The Court of Appeal in Abuja faults the election of Mohammed Sani Musa who was declared the winner of the Niger east senatorial district election

- The appellate court in a judgment read by Justice Stephen Adah declared Senator David Umaru as the senator-elect for Niger east senatorial district

- Justice Stephen Adah directs the Independent National Electoral Commission (INEC) to issue Senator Umaru with a certificate of return

The Court of Appeal sitting in Abuja has nullified the election of Mohammed Sani Musa who was declared the winner of the Niger east senatorial district election on the platform of the APC.

The appellate court in a judgment read by Justice Stephen Adah, declared Senator David Umaru as the senator-elect for Niger east senatorial district, Daily Trust reports.

Justice Adah arrived at the decision after setting aside the judgment of a Federal High Court in Abuja on the grounds that the court lacked the jurisdiction to entertain the matter having become statute barred by law.

The judge directed the Independent National Electoral Commission (INEC) to issue Senator Umaru with a certificate of return.

Reacting to the judgment, Senator Umaru said the judgment had vindicated him. He expressed appreciation to God and his supporters who stood by him.

However, the legal team representing Sani Musa expressed the intention to appeal to the Supreme Court following the decision of the Court of Appeal.

In another news report, the Supreme Court has struck out the suit filed by Senator Magnus Abe on the primaries of the All Progressives Congress (APC) in Rivers state.

In a unanimous judgment read on Monday, April 8, by the acting Chief Justice of Nigeria (CJN) Ibrahim Mohammed, the apex court dismissed the application on the basis that it lacks merit, Channels TV reports.

The court also noted that the suit is incompetent and a gross violation of orders 2 rule 8 of the Supreme Court rules.
